Terms of Sale
These General Terms of Sale (GTS) govern all commercial relations between Tyrolium (SIRET 91027536100012, headquartered at 252 Avenue Jean Jaurès, 69150 Décines-Charpieu, France) and any natural or legal person (hereinafter the Client) purchasing a product or service from Tyrolium or one of its brands (TyroServ, SolidServ, Vturias, NexiumiaCRM, etc.).
Placing an order or making a payment constitutes full and unconditional acceptance of these GTS. Tyrolium reserves the right to update these terms at any time; the version in force at the time of purchase applies.
Definitions: « Tyrolium » refers to the company and all its brands. « Client » refers to any person purchasing a product or service. « Service » refers to any digital or physical product sold by Tyrolium.
Tyrolium's data commitments: Tyrolium contractually undertakes towards the Client to (i) never sell, rent or otherwise transfer for consideration the Client's personal data to any third party; and (ii) host the personal data it collects exclusively on French territory. The only exceptions are card payment data from our online stores, processed by Stripe Payments Europe Ltd. (Ireland, EU), and services the Client expressly chooses to have hosted in another location. Any breach of these commitments constitutes a failure to perform this contract, entitling the Client to all remedies provided by law, including legal action.
These GTS are governed by French law. Any dispute shall first be resolved amicably; failing that, the competent courts of France shall have jurisdiction. Contact: juridique@tyrolium.fr
As a provider of digital services in the European Union, Tyrolium also complies with the obligations of Regulation (EU) 2022/2065 (Digital Services Act - DSA) applicable to intermediary services of its size category.
Tyrolium offers bespoke services in web development, application design, digital incubation, strategic consulting and technical training for businesses and individuals.
Orders & quotes
Every service is subject to a prior written quote drawn up by Tyrolium and valid for 30 days. The order is confirmed after receipt of the signed quote and, where applicable, the agreed deposit.
Pricing & invoicing
Prices are stated in euros (€) excluding VAT. The applicable rate is that in force at the date of quote validation. Tyrolium reserves the right to invoice additional fees in the event of scope creep beyond what was defined in the quote.
Payment terms
Delivery & deadlines
Delivery times are communicated at the time of quote signing and are indicative. Any delay attributable to the Client (late provision of content, access or feedback) may result in a postponement of deadlines without liability for Tyrolium.
Ownership of deliverables
Ownership of deliverables is transferred to the Client after full payment. Tyrolium retains the right to mention the work in its portfolio unless the Client expressly objects in writing.
Warranty & after-sales service
Tyrolium warrants its work against conformity defects for the period defined in the quote. Corrections of anomalies attributable to Tyrolium are covered free of charge during this period.
Termination
In the event of termination at the Client's initiative after work has begun, amounts for services already completed remain due. A notice period and termination fees may apply as specified in the quote.
TyroServ is a Minecraft server operated by Tyrolium. The following terms apply to the purchase of ranks (grades) and cosmetic items available on TyroServ servers.
Available grades
TyroServ offers several mineral-themed grades (Rhodonium, Aventurium, Yellorium, Volcanium, etc.) granting in-game privileges such as custom prefixes, additional commands and exclusive access to certain areas. The list of benefits associated with each grade is detailed on the TyroServ store.
Cosmetic items
Cosmetic items (skins, effects, pets, etc.) are purely aesthetic and confer no competitive advantage. They are linked to the purchasing player's account and are non-transferable. All purchases are deterministic: no random mechanism (lootbox, random draw or similar) exists on TyroServ. Each item purchased corresponds exactly to the item described and displayed at the time of purchase.
Purchases by minors
Purchases made on TyroServ by a minor require prior authorisation from the holder of parental authority. By completing a purchase, the buyer declares either that they are of legal age or that they have obtained the required parental authorisation. In the event of a purchase made by a minor without parental authorisation, Tyrolium cannot be held liable; any refund request must be submitted by the legal representative to juridique@tyrolium.fr.
Purchase & payment
Purchases are made through the official TyroServ store, operated by Tyrolium. Card payments are processed by our payment provider Stripe. Grades are activated on the server within a maximum of 24 hours after payment confirmation.
Refund policy
In accordance with Article L221-28 of the French Consumer Code, digital content delivered immediately is non-refundable once activated, except in the event of a proven technical defect on Tyrolium's part. Any refund request must be sent to juridique@tyrolium.fr within 7 days of purchase.
Suspension & revocation
Tyrolium reserves the right to suspend or permanently revoke a grade or cosmetic item without refund in the event of a serious breach of TyroServ's rules (cheating, harassment, fraud, etc.).
SolidServ is Tyrolium's hosting infrastructure. The following terms apply to all game server, VPS and dedicated server rental offers proposed by SolidServ.
Available offers
SolidServ offers monthly or annual subscriptions for game servers (Minecraft, etc.), VPS and dedicated servers. Full technical specifications (RAM, storage, bandwidth) are detailed on the SolidServ website.
Duration, renewal & payment
Availability (SLA)
SolidServ commits to a monthly availability rate of 99.5% for its infrastructure. Scheduled maintenance operations are announced at least 24 hours in advance and do not count towards downtime.
Backups
SolidServ performs daily automatic backups retained for 7 days for eligible offers. The Client remains solely responsible for their data and is advised to maintain their own backups.
Acceptable use
The Client undertakes not to use the service for unlawful activities (DDoS, spam, illicit content, etc.). Any such use will result in immediate suspension without refund.
Liability as hosting provider (DSA)
As an infrastructure hosting provider within the meaning of Article 6 of Regulation (EU) 2022/2065 (DSA), SolidServ benefits from a conditional liability exemption: it cannot be held liable for the content stored by its clients, provided that it acts expeditiously upon receiving a notification of allegedly illegal content and promptly removes or disables access to it. Any person wishing to report illegal content hosted on SolidServ must send their notification to juridique@tyrolium.fr (subject: "DSA - Illegal content hosted by SolidServ"), specifying the content, its precise location and the grounds for alleged illegality. SolidServ undertakes to process each notification diligently and to take all necessary measures.
Termination
The Client may cancel their subscription at any time from their customer area. Cancellation takes effect at the end of the current paid period, with no refund of the remaining period unless agreed otherwise.
This section covers the sale of physical merchandise (clothing, accessories, collectibles, etc.) under the Tyrolium and Vturias brands.
Order & validation
Orders are placed through the official online store. An order confirmation email is sent after payment validation. Tyrolium reserves the right to refuse any order in the event of stock shortage, suspected fraud or error in the offer.
Prices & payment
Prices are stated in euros (€) including VAT. Shipping costs are calculated at checkout based on the delivery address. Payment is made by credit card or any other method offered at checkout, processed via secure platforms.
Delivery & lead times
Right of withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the Client has a 14-day right of withdrawal from receipt of the goods, with no reason required. Items must be returned in their original condition, unused and in their original packaging. Return shipping costs are borne by the Client unless the item is defective.
Returns & refunds
Refunds are issued within 14 days of receipt of the returned item, using the original payment method. Items personalised or made to order are excluded from the right of withdrawal. To initiate a return: juridique@tyrolium.fr
NexiumiaCRM is a customer relationship management (CRM) SaaS solution developed and operated by Tyrolium. The following terms apply to all subscription plans offered on the NexiumiaCRM platform.
Subscription plans
NexiumiaCRM offers several plans (Free, Starter, Pro, Enterprise) with different feature levels. The full details of each plan are available on the NexiumiaCRM pricing page. Features may be updated at any time; existing subscribers are notified at least 30 days in advance of any material reduction in service.
Billing & automatic renewal
Free trial
Certain plans may include a free trial period (14 days). No payment is required during the trial. At the end of the trial, the subscription switches to the paid plan unless cancelled beforehand.
Cancellation
The Client may cancel their subscription at any time from the NexiumiaCRM account settings. Cancellation takes effect at the end of the current billing period; no partial refund is issued for the remaining days. After cancellation, data is retained for 30 days before being permanently deleted.
Data & confidentiality
Data entered by the Client into NexiumiaCRM remains the exclusive property of the Client. Tyrolium processes this data solely to provide the service and in compliance with the GDPR. Data is hosted on servers located in France operated by SolidServ.
Data portability
In accordance with Article 20 of the GDPR and the provisions of the DSA, NexiumiaCRM clients may request an export of their data at any time from the account settings or by contacting juridique@tyrolium.fr. Data is provided in a structured, commonly used and machine-readable format (JSON or CSV) within 30 days of the request.
Data processing agreement (GDPR Art. 28)
In using NexiumiaCRM, the Client acts as data controller and Tyrolium acts as data processor within the meaning of Article 28 of the GDPR. By accepting these GTS, the Client formally agrees to the following data processing terms, which constitute the Data Processing Agreement (DPA) required by law:
Any dispute relating to these GTS will first be submitted to an amicable resolution attempt by contacting juridique@tyrolium.fr. If no amicable solution is reached within 30 days, the parties may refer the matter to the competent courts of France.
Online Dispute Resolution (ODR - European Commission)
In accordance with Article 14 of Regulation (EU) No 524/2013, Tyrolium informs consumers that the European Commission has established an Online Dispute Resolution (ODR) platform, accessible at ec.europa.eu/consumers/odr. This platform allows consumers to resolve disputes relating to online purchases without going to court.
Certified mediator (ADR)
In accordance with Articles L612-1 et seq. of the French Consumer Code and the DSA, Tyrolium offers its consumer clients access to an Alternative Dispute Resolution (ADR) process. For B2C disputes relating to digital services, the competent supervisory authority under the DSA is the ARCOM (arcom.fr). For commercial disputes, the parties undertake to attempt mediation before any court proceedings.
